Arizona is unique in that although it does not allow criminal record expungement or removal, that it does have a ‘set aside’ policy in place under some circumstances. While your charges and record remain public, the “set aside” order demonstrates to anyone viewing your file, such as prospective employers, that you served your time or services necessary to otherwise have your case ‘dismissed’. While this is not the most ‘appealing’ feature, those with such charges are most likely to be grateful for any flexibility or modifications at all to their charge(s). Charges of certain nature such as involving a minor or vehicular accident involving intoxication are not able to be ‘set aside’.
