In most cases, in the state of Delaware, you cannot request record-expungement unless your convictions or charges were dropped. If your case was dismissed, or you were later acquitted of charges then you are likewise eligible to request to have your records sealed. In some cases, a ‘discretionary expungement’ may be requested and approved for certain, very few, misdemeanor charges such as DUI—per 11 Delaware Code § 4374. However, to be eligible for such, you must have an otherwise spot-free record to-date.
