In the state of New York if your case was set aside or terminated it is eligible to be expunged. While New York commonly uses the terminology ‘seal’, it does in fact reflect the expungement and destruction of such incidents taking place and record. However, most government agencies are in fact still able to access such offense history at any time. Only (approved) drug convictions can be expunged in the state of New York, not misdemeanors or felonies under nearly any circumstance. Such an opportunity for expungement also includes the requirements for an aversion and/or drug treatment program.
