South Dakota is quite reasonable and flexible in considering requests for sealing or expungement of arrest and criminal conviction records. In fact, nearly all misdemeanor offenses after a period of ten years are eligible for expungement assuming no charges have since occurred and all terms and conditions of release or rehabilitation have been met. Also, naturally, any charges decriminalized post-conviction are applicable and worthy of an expungement request. Lastly, those of age 75 or older and whom have maintained a clean record of infractions for at least ten years are also eligible for record sealing and expungement or destruction.
