In the state of West Virginia outside of your case being dismissed or charges dropped there is little room for expungement requested, called ‘executive pardons’. Such a pardon must come from the top, however first time drug-offenses and some misdemeanor offenses for those aged 18 to 26 will be eligible after 1 year of conviction, post-sentencing and after probation is complete. Those with charges involving minors, violence, brandishing a weapon, and DUI based convictions are not eligible for pardoning nor expungement. Those whom had their convictions downgraded or dropped on the basis of mental illness or addiction are also not eligible for expungement.
